Isn't the copyright holder in this case "anyone who has contributed to the Linux kernel"? I have to imagine that includes the FSF. Link actually says, "As such, we have today opened (at this point, non-litigation) GPL enforcement actions against both companies."

that's a letter, not a lawsuit. not yet, anyway.
